General Terms and Conditions of Use
The purpose of these General Conditions of Use (hereinafter referred to as "GCU") is to specify the terms of use and navigation within this Site.
These GCU apply to all users accessing the VisitMonaco.com website. Each User is presumed to have accepted, without reservation, these conditions when he or she continues to use the site.
The version of the GCU currently online on the Site is the only one applicable and enforceable against the User until a new version replaces it. The Administration reserves the right to modify these GCU at any time, which will come into force as soon as they are published on the Site.
The User is therefore advised to refer regularly to the latest version of the GCU, which is permanently available on the Site.
No tolerance in the application of the provisions of the GCU may be interpreted as a waiver by the Administration of its right to invoke them at a later date.
If any of the provisions hereof are or become invalid under any present or future legal provision, they shall be deemed unwritten without affecting the validity of the other provisions hereof.
1. DEFINITION
The words and expressions below beginning with a capital letter, in the singular or plural, are used herein with the following meaning:
- " Administration ": refers to the Government of Monaco/Directorate of Digital Services.
- " General Conditions of Use " or "GCU": refers to these GCU.
- " Personal data " / " Personal data " / " Nominative information ": refers to any information relating to an identified or identifiable natural person ("data subject"). An "identifiable natural person" is any natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.
- " Functionalities ": refers to the functionalities offered via the site enabling any User to:
- " Data controller ": means the natural person or legal entity, whether governed by private or public law, the public authority, the service or any other body which determines, alone or jointly with others, the purpose and means of the processing and which decides on its implementation.
- " Site ": refers to the VisitMonaco.com website (www.visitmonaco.com);
" User ": refers to any individual or legal entity using the VisitMonaco.com site and accessing the Services offered by this site.
2. PURPOSE
The purpose of these General Conditions of Use is to specify the conditions of access to and use of the Visitmonaco website. The latter provides tourist information and promotes the Destination, in particular through a route generator, an interactive map, articles and a calendar of events.
3. ACCESS TO THE WEBSITE
In order to take full advantage of all its functionalities, the Visitmonaco website requires the availability of a sufficiently fast Internet connection as well as equipment and material resources enabling access to and browsing on the Internet, at the User's expense.
The Services can be accessed free of charge and securely via the URL https://visitmonaco.com.
In the event of interruption or impossibility of use of the Services, the User may contact the Administration to obtain information.
4. COMMITMENT CONCERNING THE USE OF THE SITE AND ITS CONTENT
The present General Terms and Conditions of Use prohibit any act which may contribute to tarnishing the name and/or image of the State of Monaco, or which may damage, overload, disable, discredit or undermine the Website.
The following in particular are prohibited: transmission via the Site, by electronic mail or by any other means, to associate the Site with content serving the purposes of persecution, harassment, defamation, discrimination, insults, or any other dissemination of information or opinion of a personal nature about one or more individuals or infringing the rights of the individual or of minor Users.
Correspondence with the D.T.C. via the dedicated contact form must in all circumstances be courteous and comply with the elementary rules of politeness.
5. SITE SECURITY
Users are prohibited from fraudulently accessing or remaining on all or part of the Site, deleting or modifying content, fraudulently introducing data, altering the Site or disrupting its proper operation.
Thus, it is strictly forbidden: (i) to reproduce, modify, adapt or alter the Site and/or its content; (ii) to use the Site for illicit purposes; in this respect, the User undertakes not to include any false, incomplete or inaccurate information, to include any virus, Trojan horse, worm, time bomb or any other programme designed to damage, produce a harmful effect, intercept or counter any system, data or personal information.
6. INTELLECTUAL PROPERTY RIGHTS
These General Terms and Conditions of Use do not imply any transfer of intellectual property rights of any kind to the User.
1. Copyright
All rights attached to any content published on this Site are the exclusive property of the Administration, unless otherwise stated. This includes, but is not limited to, all texts, comments, titles, names, photographs, sounds, images, data, drawings, audio sequences, videos, functionalities and graphic charts and are protected by the legal provisions in force relating to the protection of copyright in Monaco.
Any form of use, representation, transformation, reproduction, adaptation or distribution, in whole or in part, of any element or content of this Website on any medium and by any process whatsoever is prohibited, unless expressly authorised by the Administration and constitutes a criminal offence punishable by the Monegasque Courts and Tribunals.
2. Trademarks
The trademarks and/or logos owned by the Administration and appearing on this Website are trademarks protected by the legal provisions applicable in Monaco. Any reproduction, in whole or in part, without the authorisation of the owner constitutes an offence punishable by the Monegasque Courts and Tribunals.
7. LIABILITY
The Services must not be used in an abusive or malicious manner. The User is aware of the risks inherent in the use of the Internet, such as possible misappropriation, and accepts the limits and risks thereof.
In general, the User undertakes to use the Services:
- In compliance with the law, with Monegasque regulations, with the rights of third parties and with intellectual property rights;
- In a loyal manner and in accordance with their intended purpose;
- Under its exclusive responsibility.
The Administration may not be held liable for malfunctioning of the Site and the consequences thereof arising from malfunctioning or restricted or degraded access to the Internet.
The Administration gives no guarantee, implicit or explicit, concerning the operation of this Site and may under no circumstances be held responsible for any damage, direct or indirect, commercial or otherwise, or effects that may result from an erroneous or obsolete publication on it.
8. PROTECTION OF PERSONAL DATA
In accordance with the provisions applicable to personal data in the Principality of Monaco, the information collected via the Visit Monaco Website is collected by the State of Monaco/Direction du Tourisme et des Congrès, hereinafter referred to as "the DTC" (2, rue de la Lüjerneta - 98000 MONACO), hereinafter referred to as "the Administration", which acts as the data controller. When accessing the Visit Monaco website, a banner with information on cookies informs the User of the various cookies placed on the site and offers personalised cookie management. All data collected by the Visit Monaco website is hosted in Monaco and the service provider responsible for integrating the website is located in France.

The copy of the identity document must be provided in black and white.
The copy of the identity document is deleted once the request is closed.
The persons concerned may refer the matter to the Personal Data Protection Authority if they consider that the Government has not complied with its undertakings relating to the exercise of rights.
9. HYPERTEXT LINKS
The creation of hypertext links to this Site is not subject to any prior authorisation by the Government and is authorised for any medium, with the exception of those disseminating information of a controversial, pornographic or xenophobic nature or which may, to a greater extent, offend the sensibilities of the general public. The State of Monaco must be explicitly mentioned in the title of the link. The Administration reserves the right to request the removal of any existing links that contravene the purpose of the site.
The Administration's VisitMonaco website may contain hyperlinks to external websites. The Administration does not control these sites and cannot be held responsible in any way whatsoever for the content published on these external sites.
The Administration may not be held liable for any damage or loss arising from or in connection with the use of these external sites. Users of the Site are fully responsible for and bear the risks associated with the use of these external sites. No liability may be sought from the Administration.

10. APPLICABLE LAW - JURISDICTION
Any dispute relating to the subject of these GCU shall be governed solely by Monegasque law.
In the absence of an amicable settlement, any dispute relating to the subject matter of these GCU shall be referred to the Monegasque courts and tribunals, which shall have exclusive jurisdiction in the matter.
